AEONIX TERMS OF USE

Please read these Terms of Use ("Terms") carefully before using Aeonix. "Aeonix" means AllesHealth GmbH's preventive health screening platform, however accessed — including the Aeonix mobile application, the Aeonix website, and any related booking, results, or support services (together, the "Service"). Aeonix is operated by AllesHealth GmbH ("AllesHealth", "we", "us"). By tapping or clicking "I Agree", creating an account, booking a screening, or otherwise using Aeonix — whether through the mobile app or the website — you ("you", "Customer") confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy & Health Data Consent. If you do not agree, do not use Aeonix.

1. About Aeonix and AllesHealth's Role

Aeonix is a preventive health screening platform, available through the Aeonix mobile application and the Aeonix website, that helps you book biomarker testing, view your results, and track wellness trends over time. AllesHealth operates Aeonix and its underlying technology platform, coordinates bookings made through either channel, and displays your results to you.

AllesHealth is a technology and coordination platform. AllesHealth is not a medical practice, does not employ physicians to diagnose or treat you through Aeonix, and does not itself collect or analyse biological samples. Sample collection and laboratory analysis are performed by independent, third-party medical laboratories authorised to operate in Switzerland (each, a "Laboratory Partner"). AllesHealth's current Laboratory Partner is LabPoint Laboratoires Médicaux SA. AllesHealth may change or add Laboratory Partners from time to time.

The results you see in Aeonix ("Customer-Facing Output") are a digital presentation of the structured laboratory data ("Clinical Output") generated by our Laboratory Partner. AllesHealth displays this data as received from our Laboratory Partner. As set out in Section 12 below, AllesHealth does not independently verify, audit, or guarantee the underlying Clinical Output, and accepts no responsibility for its clinical accuracy.

2. Preventive Screening, Not Diagnosis

Aeonix provides preventive, wellness-oriented biomarker screening. It is intended to help you and your healthcare provider monitor general health trends over time.

Aeonix is not a diagnostic service. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition, and it does not constitute medical advice, a medical opinion, or a treatment recommendation.

If you have an existing diagnosed medical condition, you should continue to follow the diagnosis, treatment, and monitoring plan provided by your treating HCP. Aeonix is not a substitute for that ongoing care, and you, as an Aeonix Customer, should not rely on preventive screening results in place of your HCP's diagnosis or medical advice.

No doctor-patient relationship is created between you and AllesHealth, or between you and our Laboratory Partner, by your use of Aeonix.

No biomarker screening test, however performed, is completely accurate. By using Aeonix, you acknowledge and accept that results may include false positive results (indicating a condition that is not in fact present) or false negative results (failing to indicate a condition that is in fact present), that screening may not detect every condition relevant to your health, and that results are limited to the markers included in the package you selected. A result within the reference range does not guarantee the absence of a health condition, and a result outside the reference range does not, on its own, confirm one. You assume the risk of these inherent limitations by choosing to use Aeonix.

3. Not for Medical Emergencies

Aeonix is not designed or intended for use in medical emergencies. If you believe you are experiencing a medical emergency, call your local emergency number (144 in Switzerland) or go to the nearest emergency room immediately. Do not rely on Aeonix or wait for test results in an emergency.

4. Always Consult Your Healthcare Provider

You should discuss all Aeonix results with a licensed healthcare provider ("HCP") — such as your general practitioner — before making any decision about your health, including any decision to seek, delay, or forgo medical treatment. AllesHealth strongly recommends that you share your Aeonix results with your treating physician.

AllesHealth and our Laboratory Partner do not provide the clinical interpretation of your results in the sense of a diagnosis; that responsibility rests exclusively with a qualified HCP whom you consult independently. You agree that you have not relied, and will not rely, on AllesHealth for medical interpretation of any result, and that any decision you make based on Aeonix results is made at your own discretion and risk.

5. Role of Our Laboratory Partner

Sample collection and laboratory analysis are performed by our Laboratory Partner in accordance with applicable Swiss regulatory requirements, including QUALAB quality standards and, where held, ISO 15189 accreditation. Our Laboratory Partner is solely responsible for the accuracy, completeness, and clinical validity of the Clinical Output it generates, including the risk of false positive or false negative results. AllesHealth relies on our Laboratory Partner to perform testing to a professional standard, is not itself a party to the analytical testing process, and does not supervise, re-test, or independently verify any Clinical Output before displaying it to you.

6. Eligibility

You must be at least 18 years old to create an Aeonix account and use the Service in your own name.

If Aeonix is made available for use by or on behalf of a minor, this requires the informed consent of a parent or legal guardian, obtained in accordance with applicable law.

You confirm that the information you provide during registration and booking — whether via the app or the website — is accurate and that you are legally capable of consenting to the collection of a biological sample for testing.

7. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, regardless of whether you access Aeonix through the mobile app or the website. Notify us promptly at the contact details below if you suspect unauthorised use of your account.

8. Booking and Sample Collection

You may book a Standard Package or add-on screening through the Aeonix mobile app or the Aeonix website.

Standard Package results are generally available within forty-eight (48) to seventy-two (72) hours of sample collection; add-on screenings, including genetic testing, may take up to fourteen (14) days.

Turnaround times are estimates and may vary due to factors outside AllesHealth's control, including laboratory processing volumes, sample quality, or circumstances at the collection centre.

You are responsible for attending your scheduled collection appointment and for following any pre-test instructions (e.g. fasting) provided to you.

9. Intellectual Property

The Aeonix mobile application, the Aeonix website, their design, trademarks (including "Aeonix"), and underlying software are the property of AllesHealth or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use Aeonix for your personal, non-commercial use in accordance with these Terms.

10. Prohibited Uses

• Use Aeonix for any unlawful purpose or in a way that infringes the rights of others;
• Attempt to reverse-engineer, decompile, or gain unauthorised access to the Aeonix platform or its data;
• Submit a biological sample belonging to another person as if it were your own, or otherwise misrepresent your identity;
• Rely on Aeonix as a substitute for professional medical advice, diagnosis, or treatment.

11. Disclaimer of Warranties

AEONIX AND ALL CLINICAL OUTPUT AND CUSTOMER-FACING OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

To the maximum extent permitted by Swiss law, AllesHealth disclaims all warranties regarding the Service and any results provided through it, including, without limitation, any warranty of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, or that the Service will be uninterrupted or error-free. AllesHealth specifically does not warrant that any Clinical Output or Customer-Facing Output is free from false positive or false negative results, or that it will detect any particular health condition. Nothing in this Section limits any warranty that cannot lawfully be excluded under Swiss law.

12. Limitation of Liability

NO LIABILITY FOR LABORATORY RESULTS. AllesHealth is a technology and coordination platform, not a laboratory. AllesHealth does not generate, supervise, re-test, or independently verify Clinical Output. To the maximum extent permitted by Swiss law, AllesHealth shall have no liability whatsoever for any loss, injury, or damage of any kind arising from or relating to: (a) a false positive or false negative result; (b) any error, omission, delay, or inaccuracy in Clinical Output or Customer-Facing Output; or (c) any decision you or any third party makes in reliance on a result. Responsibility for the matters in this paragraph rests exclusively with our Laboratory Partner, and your recourse, if any, in respect of such matters lies against our Laboratory Partner and not against AllesHealth.

Subject always to the mandatory exceptions in the following paragraph, AllesHealth's aggregate liability to you for any other claim arising out of or relating to your use of Aeonix (for example, a platform malfunction directly attributable to AllesHealth, or a billing error) shall not exceed the amount you paid for the Standard Package or add-on screening giving rise to the claim, and AllesHealth shall in no event be liable for indirect, consequential, or punitive damages, or for loss of data, in each case save in cases of fraud, wilful misconduct, or gross negligence on AllesHealth's own part.

Nothing in these Terms excludes or limits AllesHealth's liability for death or personal injury caused by AllesHealth's own negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot lawfully be excluded or limited under Swiss law (including Article 100 of the Swiss Code of Obligations). For the avoidance of doubt, this mandatory exception does not extend liability to AllesHealth for the clinical accuracy of Clinical Output generated by our Laboratory Partner, which remains excluded under this Section to the fullest extent Swiss law permits.

13. Indemnification

You agree to indemnify and hold AllesHealth harmless from any claim, loss, or expense arising out of your breach of these Terms, your misuse of the Service, your provision of inaccurate information, or any decision made by you or a third party in reliance on a result obtained through Aeonix, except to the extent finally determined to have been caused by AllesHealth's own fraud, wilful misconduct, or gross negligence.

14. Termination

You may stop using Aeonix and close your account at any time through the app, the website, or by contacting us. AllesHealth may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or if required to do so by law. Sections of these Terms which by their nature should survive termination (including Sections 11, 12, 13, and 18) will survive.

15. Changes to These Terms

AllesHealth may update these Terms from time to time to reflect changes in the Service, our Laboratory Partners, or applicable law. We will notify you of material changes through the app or website before they take effect. Continued use of Aeonix after a change takes effect constitutes your acceptance of the updated Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the substantive laws of Switzerland, excluding its conflict-of-law rules. Subject to any mandatory consumer-protection venue rules that cannot be excluded, the courts of Basel-Landschaft, Switzerland, shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

17. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with the Privacy & Health Data Consent, constitute the entire agreement between you and AllesHealth regarding your use of Aeonix, whether accessed via the mobile app or the website.
